Deed of Absolute Sale
After having a notarial document , obtaining some documents from Cityhall to be presented to BIR examiner and wait for the computation of taxes such as capital gain tax and documentary stamp tax ( for individual or creditable witholding tax ( for corporation ) , pay them for the issuance of Certificate Authority Registration ( CAR ) .
After having a CAR pay for transfer tax and now you're ready to proceed to Register of Deeds togetrher with those pertinent documents for transfering of title .
The last part is having a photocopied of those documents including CAR and presenting them to assessor's office in your cityhall to transfer tax declaration for taxation of new owner's reralty tax.
Deed of Extra-judicial Seetlement of Estate
Extra-judicial means out of court settlement , this is somewhat very complicated process of transfering of title when one or both owner ( husband or wife ) are conjugal died and their heirs part in the property or whole transfer to them . This must be done by a knowledgeable licensed real estate broker to avoid extra expenditures in the part of the owner or heirs as soon as the person died , call a broker immedietly because some important documents to be presented have expiry lenght of time . Presenting late to BIR you will be charge more without your knowing .
Process is almost the same with some variation like payment of estate tax and no documentary tax . Beware of government hidden charges most people don't know . You can avoid this if done correct and case to case basis . Publishing is needed.
Deed of Donation
When the owner is doing a estate planning and wish to donate partial or his property to heirs or to anybody . Notarized deed is needed and subdivision plan if for subdivide to be presented to BIR for registration .
The process is the same and payment varies according to relationships, estate tax is charge . Notify your broker immedietly to arrange your documents .
Affidavit of Self Adjudication
A complicated one happens when the owner is lone survivor after the partner died and plan to sell the property must be prove to government agency that a person have no heirs to inherit and want to enjoy the benefit of it . This is where he/she made a lone decision for himself/herself for what he intended to do . The process is the same . notarized document is needed and pays estate tax and docs tamp tax and must be published to be annotated in the title . After this absolute sale must be raedy .
